Terms and Conditions

1. Acceptance of Terms

These Terms and Conditions (“Terms”), together with any related consent form, invitation, participation form, questionnaire, survey instrument, policy notice, notice of privacy practices, and such other ancillary or supplementary documentation as may hereinafter be issued, promulgated, circulated, or otherwise made available by the organization, shall constitute the entire operative framework governing participation in the Holistic Pursuit for Wellness health analysis program (“Program”). By submitting an application, completing a form, providing any data, continuing participation, or otherwise availing oneself of the Program in any manner whatsoever, the participant acknowledges, admits, confirms, and irrevocably agrees that he or she has read, understood, accepted, and bound himself or herself to these Terms in their entirety, whether or not every sentence, clause, subclause, or incidental provision has been individually scrutinized, itemized, or verbally rehearsed.

If any participant does not agree to the whole or any portion of these Terms, such participant shall not be deemed qualified to continue, remain, or be retained in the Program, and any attempted participation shall be regarded as null, void, revocable, and without binding effect upon the organization.

2. Nature of the Program

The Program is a voluntary, non-prescriptive, observational, longitudinal health analysis initiative operated by a multidisciplinary collective of doctors, dietitians, scientists, and related health professionals, with the stated objective of identifying, decoding, analyzing, comparing, and interpreting health trends, behavioral tendencies, physiological correlations, and broader wellness patterns through aggregated participant information. The Program is not a substitute for medical consultation, diagnosis, treatment, prescription, emergency care, or individualized clinical instruction. The Program does not direct a participant’s daily life, personal beliefs, dietary autonomy, therapeutic decisions, or professional medical care.

The organization’s stated framework is evidence-driven and holistic in orientation, with the intent to derive broad wellness insights and to inform the development of food supplements, vitamins, minerals, and related wellness supports. Participation is intended to contribute to a collective understanding of human wellness, lifestyle variation, and health-related patterns, and may also allow eligible participants to receive recognition, certificates, and discretionary incentives, subject always to the Terms herein and to the organization’s final determination.

3. Eligibility

Only persons who satisfy all of the following conditions may be accepted into the Program:

a. The person must be at least twenty (20) years of age at the time of enrollment.
b. The person must possess sufficient cognitive capacity to comprehend the nature, scope, consequences, expectations, and disclosures associated with the Program.
c. The person must be capable of reading, writing, understanding, and responding in English and in his or her native language, to the extent necessary to complete the forms and to communicate with the organization.
d. The person must be able, in good faith, to provide self-reported information regarding daily living, diet, lifestyle, mood, sleep, activity, symptoms, and other health-related matters that he or she is willing to disclose.
e. The person must not be otherwise disqualified by the organization pursuant to these Terms, any program rule, any compliance requirement, or any internal determination relating to suitability, sincerity, honesty, or participation quality.

The organization may require an application form, a detailed screening form, or such additional verification materials as it deems necessary, proper, prudent, and administratively expedient to confirm eligibility, authenticity, competence, and candid participation. Completion of such materials does not guarantee acceptance.

4. Enrollment, Invitation, and Household Limitation

Enrollment is voluntary and invitation-based. The organization may invite, request, screen, or otherwise offer an eligible person the opportunity to participate, but shall not compel, coerce, force, intimidate, or unlawfully pressure any individual into joining.

For the sake of maintaining diversity of data, reducing duplication, and preserving the integrity of the analysis, only one person within a family unit, including cousins, may participate at any given time unless the organization expressly permits otherwise in writing. Any exception, waiver, or deviation from this household limitation must be made in writing by the organization and shall be construed narrowly, cautiously, and strictly.

The organization reserves the right, in its sole and absolute discretion, to accept, reject, postpone, suspend, condition, or revoke participation at any stage, with or without explanation, subject only to such minimum legal requirements as may not lawfully be disclaimed.

5. Voluntary Participation and No Forced Conduct

Participation is entirely voluntary, and no participant shall be required to remain in the Program against his or her will. Likewise, no participant shall be compelled to change personal beliefs, stop lawful medical treatment, adopt dietary instructions contrary to a physician’s advice, or otherwise surrender bodily autonomy, decisional independence, or personal agency.

If a participant is currently taking medication prescribed by a licensed physician or other qualified medical professional, the participant must continue to follow that professional’s instructions unless and until the treating professional advises otherwise. The organization does not supplant, supersede, replace, or override the participant’s personal healthcare providers.

The organization’s role is limited to observation, collection, organization, comparison, and analysis of self-reported wellness information, and not to the issuance of individualized medical orders or compulsory conduct instructions.

6. Participant Responsibilities

The participant agrees to provide truthful, accurate, sincere, and non-fraudulent information to the extent he or she elects to provide information. The participant understands that the depth, breadth, and detail of responses may be offered on a voluntary basis, but that the quality of the Program depends materially upon honest, relevant, coherent, and reasonably complete self-reporting.

Without limiting the generality of the foregoing, a participant may be asked to provide information concerning diet, lifestyle, mood, sleep, energy levels, physical activity, exercise, symptoms, sickness, feelings, habits, daily experiences, and other wellness-related circumstances that the participant is willing to share. The participant is not required to disclose every private detail; however, incomplete, false, contradictory, misleading, malicious, or fabricated entries may affect eligibility, continuation, recognition, incentives, or continued inclusion in the Program.

The participant also agrees to comply with lawful instructions relating to form submission, communication protocols, survey completion, presence, participation frequency, and any administrative guidance issued by the organization from time to time.

7. Data Collection and Scope of Information

The organization may collect and process only such information as is voluntarily supplied, directly entered, or affirmatively submitted by the participant through the relevant forms, questionnaires, correspondence, participation logs, and program interfaces. Based on the source materials, the Program does not seek fingerprints, does not request geolocation data, and does not require biometric fingerprinting for participation. The participant’s address may be known only if the participant personally and willingly provides it in a form or related submission.

The organization may also process administrative and participation-related information necessary to manage the participant’s enrollment status, presence, compliance, certificate issuance, incentive determination, and continuation or termination decisions. Data may be reviewed on an aggregated basis, and the participant acknowledges that the Program’s privacy design is intended to avoid individual-by-individual public exposure and to operate in a blind-study style environment.

8. Privacy, Confidentiality, and Blind-Study Handling

The participant acknowledges and agrees that the Program is structured around systemic privacy protection, data aggregation, and blind-study standards, with the express objective of maintaining confidentiality, reducing bias, and shielding individual identities from unnecessary exposure. The organization states that it does not sell participant data to third parties and does not analyze information in a manner intended to publicly single out any participant as an identifiable subject of public disclosure.

The participant further agrees that any information submitted in the course of participation may be processed by authorized internal personnel, internal systems, and controlled internal teams operating under the umbrella of the organization, including teams responsible for health analysis, administration, certificate processing, incentives, and supplement-related operations. The organization’s materials indicate that these teams are internal rather than external research institutions, and that third-party dissemination is not the intended design of the Program.

9. Data Use for Analysis and Wellness Development

The participant agrees that submitted information may be used, individually and collectively, for the purpose of identifying trends, tendencies, correlations, patterns, and broader wellness indicators. The organization may also use aggregated findings to develop or improve food supplements, vitamins, minerals, and related wellness-support products. The Program distinguishes such use from the sale of a participant’s personal data as a discrete, named, individualized commodity.

The participant understands and accepts that the organization’s stated purpose is to draw conclusions about health, longevity, quality of life, and wellness from broader data patterns. The organization further asserts that it is independent from government agencies and pharmaceutical sectors, and the participant accepts that such independence is intended to protect objectivity and lessen external bias.

10. Certificates, Recognition, and Incentives

Subject to successful completion, continuation, compliance, and the organization’s final assessment, a participant may be eligible to receive a Certificate of Contribution, a Certificate of Completion, and discretionary Incentives or honorarium. The source materials indicate that such recognition is not automatic, not universal, and not guaranteed in equal amount to all participants, but rather depends upon factors such as presence, participation consistency, quality of data, honesty, relevance, and the overall usefulness of the information shared.

The organization may condition incentive eligibility upon completion thresholds, including a general expectation of at least fifty percent (50%) participation or comparable completion criteria as measured across survey inputs, attendance or presence, and overall involvement, subject to the organization’s administrative discretion and final verification.

11. Minimum Participation Period and Continuation

The participant acknowledges that the Program is designed as a long-term study with a minimum duration of one (1) year and a possible extension of up to ten (10) years, with annual increments and review points. After the initial year, the participant may request discontinuation, and the organization may also invite the participant to continue, subject to suitability and program need. Certificates and incentives, however, are generally intended to be released upon the final conclusion of participation, whether that conclusion occurs after one year or after a later extension period.

12. Voluntary Withdrawal

A participant may request withdrawal at any time, and the organization states that such requests are to be processed within approximately one week. Withdrawal before completion of the minimum participation period may result in the forfeiture of certificates, incentives, and related benefits. The participant acknowledges that withdrawal does not necessarily erase all administrative records and does not entitle the participant to completed-program benefits that were expressly contingent on continued participation.

13. Data Retention, Storage, and Duration of Holding

The participant hereby acknowledges, understands, and expressly agrees that any and all information, data, entries, submissions, responses, declarations, and related materials voluntarily provided, whether in whole or in part, shall be retained, stored, archived, preserved, and maintained by the organization for the full operational duration of the Program, which may extend from a minimum period of one (1) year up to a maximum duration of ten (10) years, inclusive of any extensions, renewals, continuations, or successive participation cycles.

Such retention shall be undertaken for purposes including, but not limited to, longitudinal comparison, temporal analysis, pattern recognition, trend identification, cross-referencing of historical data, validation of outcomes, and the preservation of research continuity. The participant further agrees that retention may continue for a reasonable administrative, archival, or compliance period even after withdrawal, termination, or completion, insofar as such continued retention is necessary, appropriate, customary, or operationally justified.

The organization shall employ reasonable, appropriate, and proportionate safeguards—administrative, technical, and organizational in nature—to prevent unauthorized access, accidental disclosure, improper use, or unlawful destruction of participant data; however, the participant acknowledges that no system of storage, whether digital or physical, can be declared absolutely infallible, impregnable, or immune from all conceivable risks.

14. Presence, Participation Frequency, and Engagement Expectations

The participant understands and accepts that continued inclusion in the Program is not merely a matter of passive enrollment but requires a reasonable degree of active engagement, participation, responsiveness, and presence. Such presence may include, without limitation, the completion of forms, submission of periodic entries, attendance in scheduled or unscheduled check-ins (if applicable), and responsiveness to communications issued by the organization.

The organization may, in its sole and absolute discretion, define, redefine, interpret, or adjust what constitutes “sufficient participation,” “adequate presence,” or “meaningful engagement,” taking into consideration the nature, frequency, consistency, completeness, and reliability of the participant’s contributions.

Failure, neglect, omission, or refusal to maintain a reasonable level of participation—whether through prolonged inactivity, repeated non-response, incomplete submissions, or inconsistent engagement—may result in warning, suspension, limitation of benefits, or outright disqualification from the Program.

15. Disqualification, Suspension, and Removal

The organization reserves the unequivocal, unilateral, and discretionary right to suspend, disqualify, remove, or otherwise terminate a participant’s involvement in the Program at any time, with or without prior notice, and with or without the obligation to provide detailed explanation, subject only to applicable legal constraints.

Grounds for such action may include, but shall not be limited to:

a. Submission of false, misleading, fabricated, or intentionally distorted information;
b. Repeated failure to participate, respond, or comply with participation expectations;
c. Violation of the household limitation (including multiple participants within the same family without authorization);
d. Conduct deemed disruptive, abusive, hostile, inappropriate, or contrary to the objectives of the Program;
e. Misrepresentation of identity, eligibility, or personal circumstances;
f. Attempt to manipulate, exploit, or improperly influence Program outcomes, incentives, or analysis;
g. Any act or omission which, in the organization’s judgment, compromises the integrity, credibility, or operational stability of the Program.

Disqualification shall result in the forfeiture of any pending or prospective certificates, incentives, honoraria, or recognition, unless the organization expressly determines otherwise in writing.

16. Non-Disclosure, Confidentiality Obligations, and Information Restraint

The participant agrees, undertakes, and covenants that any internal information, procedural details, program structures, methodologies, analytical approaches, communication content, or any other non-public information obtained, encountered, or accessed in connection with the Program shall be treated as confidential, privileged, and restricted.

The participant shall not disclose, publish, disseminate, reproduce, distribute, or otherwise communicate such information to any third party, whether verbally, electronically, digitally, in writing, or through any medium whatsoever, without prior written authorization from the organization.

This obligation of confidentiality shall survive withdrawal, termination, completion, or expiration of participation and shall remain binding for so long as the information retains its confidential character, or for such duration as may be reasonably necessary to protect the organization’s legitimate interests.

17. Intellectual Property and Ownership of Data

All aggregated data, analytical outputs, interpretations, findings, conclusions, summaries, reports, derivative works, methodologies, and any intellectual output arising from the Program shall remain the sole, exclusive, and perpetual property of the organization.

The participant, by virtue of participation, does not acquire, obtain, or retain any ownership rights, intellectual property rights, or proprietary claims over the Program’s outputs, whether individually or collectively derived.

Notwithstanding the foregoing, the participant retains ownership over his or her personal identity and the raw information voluntarily provided; however, the participant grants to the organization a non-exclusive, irrevocable, royalty-free, perpetual, and worldwide license to use such information for Program-related purposes, including analysis, development, improvement, and internal application.

18. No Guarantee of Outcome, Benefit, or Improvement

The participant expressly acknowledges that the Program does not guarantee, promise, assure, or warrant any specific outcome, benefit, improvement, health result, or personal advantage. Participation is undertaken with the understanding that results, if any, may vary significantly from one individual to another and may be influenced by numerous external, internal, environmental, genetic, behavioral, and lifestyle factors beyond the organization’s control.

Certificates, incentives, and recognition are not guaranteed entitlements but are conditional, discretionary, and subject to fulfillment of the Program’s requirements, as well as the organization’s final determination.

19. No Mandatory Purchase, Financial Neutrality, and Absence of Fees

Participation in the Program is free of charge. The organization does not impose, require, mandate, or compel the purchase of any product, supplement, service, or item as a condition of participation.

Any decision by a participant to purchase supplements, vitamins, minerals, or related products developed or associated with the organization shall be entirely voluntary, discretionary, and independent of Program eligibility or continuation. The absence of purchase shall not prejudice, diminish, or negatively affect the participant’s standing in the Program.

20. Non-Prescriptive Nature and Medical Disclaimer

The participant acknowledges, understands, and agrees that the Program is not engaged in the practice of medicine, diagnosis, prescription, or individualized clinical treatment. Any information, observation, or general insight arising from the Program shall not be construed as medical advice, clinical instruction, or professional healthcare guidance.

Participants are strongly encouraged to consult their own licensed physicians, healthcare providers, or qualified professionals regarding any medical condition, treatment, medication, or health-related concern. The organization disclaims any liability arising from a participant’s decision to alter, discontinue, or disregard professional medical advice.

21. Limitation of Liability

To the fullest extent permitted by applicable law, the organization, its members, affiliates, officers, employees, representatives, and associated personnel shall not be liable for any direct, indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or in connection with participation in the Program.

This includes, but is not limited to, any loss of data, loss of opportunity, perceived or actual health outcomes, dissatisfaction, inconvenience, or any other claim, whether based in contract, tort, negligence, strict liability, or otherwise, even if the organization has been advised of the possibility of such damages.

The participant assumes full responsibility for his or her own decisions, actions, interpretations, and use of any information derived from the Program.

22. Indemnification

The participant agrees to indemnify, defend, and hold harmless the organization and its affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to:

a. The participant’s breach of these Terms;
b. The participant’s misuse of the Program or its information;
c. Any false or misleading information provided by the participant;
d. Any act or omission by the participant that results in harm to the organization or third parties.

23. Amendments, Modifications, and Revisions

The organization reserves the full, absolute, unilateral, and discretionary right, at any time and from time to time, to amend, modify, revise, supplement, restate, expand, reduce, or otherwise alter these Terms, in whole or in part, whether such changes are minor, material, procedural, substantive, or otherwise consequential in nature.

Such amendments may be effected for purposes including, but not limited to, operational improvement, legal compliance, clarification of provisions, enhancement of participant protections, adaptation to evolving program structures, or alignment with updated policies and practices. The participant acknowledges that it is his or her continuing responsibility to review, revisit, and remain apprised of any such modifications.

Continued participation, continued submission of information, or continued engagement with the Program after any amendment shall constitute full, binding, and irrevocable acceptance of the revised Terms, regardless of whether the participant has explicitly reviewed or consciously acknowledged the specific changes made.

24. Communication Protocols and Notices

The participant agrees that all communications, notices, instructions, updates, clarifications, announcements, reminders, and related correspondence may be transmitted, conveyed, or delivered through such channels as the organization may deem appropriate, including but not limited to electronic mail, messaging platforms, digital forms, online dashboards, or other communication systems.

The participant bears the responsibility to ensure that contact details provided are accurate, current, accessible, and functional. Failure to receive a communication due to outdated, incorrect, inaccessible, or unattended contact information shall not invalidate the communication nor excuse non-compliance.

Any notice issued by the organization shall be deemed received upon transmission or upon reasonable lapse of time after dispatch, whether or not the participant has actually opened, read, or acknowledged such notice.

25. Independent Participation and Non-Agency

Nothing in these Terms shall be construed, interpreted, or implied as creating any partnership, joint venture, employment relationship, agency relationship, fiduciary duty, or similar association between the participant and the organization.

The participant acts solely as an independent volunteer contributor of information and shall not represent himself or herself as an employee, agent, representative, spokesperson, or authorized delegate of the organization unless expressly authorized in writing. Any unauthorized representation shall be considered a material breach of these Terms.

26. Non-Transferability and Personal Nature of Participation

Participation in the Program is strictly personal, individual, non-transferable, and non-assignable. The participant shall not transfer, assign, delegate, sublicense, or otherwise convey his or her participation rights, responsibilities, or status to any other person, whether by agreement, arrangement, substitution, or informal understanding.

Any attempt to substitute another individual, submit entries on behalf of another, or otherwise misrepresent authorship or identity shall constitute grounds for immediate disqualification and potential further action as deemed appropriate by the organization.

27. Force Majeure and Uncontrollable Events

The organization shall not be held liable, responsible, or accountable for any delay, interruption, suspension, modification, or termination of the Program arising from events beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemics, epidemics, governmental actions, regulatory changes, technological failures, system outages, cyber incidents, labor disputes, or any other unforeseen or uncontrollable circumstances.

In such events, the organization may, at its discretion, suspend operations, adjust timelines, modify requirements, or terminate the Program in whole or in part, without incurring liability to participants.

28. Dispute Resolution and Good Faith Engagement

In the event of any dispute, disagreement, controversy, or claim arising out of or relating to these Terms or the participant’s involvement in the Program, the parties shall first endeavor, in good faith, to resolve such dispute through informal discussion, mutual consultation, and reasonable negotiation.

Should such efforts fail to produce a satisfactory resolution within a reasonable period, the organization reserves the right to determine an appropriate resolution mechanism, which may include mediation, administrative review, or other non-litigious processes, prior to any formal legal action.

The participant agrees to engage in such processes in good faith, without unnecessary escalation, hostility, or bad faith conduct.

29. Governing Law and Jurisdiction

These Terms shall be governed by, construed, and interpreted in accordance with the applicable laws of the jurisdiction in which the organization operates, without regard to conflict-of-law principles.

Any legal action, claim, or proceeding arising out of or in connection with these Terms shall be brought before the appropriate courts or tribunals of such jurisdiction, and the participant hereby submits to the jurisdiction thereof, waiving any objection based on venue, inconvenience, or forum non conveniens, to the extent permitted by law.

30. Severability and Partial Invalidity

If any provision, clause, sentence, or part of these Terms is found to be invalid, unlawful, unenforceable, or void by a court or competent authority, such provision shall be severed from the remainder of the Terms without affecting the validity and enforceability of the remaining provisions.

The remaining provisions shall continue in full force and effect as though the invalid portion had never been included, and the parties shall endeavor to interpret the remaining provisions in a manner that most closely reflects the original intent.

31. Waiver and Non-Enforcement

The failure, delay, or omission by the organization to enforce any provision of these Terms shall not be construed as a waiver of such provision or of the right to enforce it at a later time.

Any waiver, to be valid, must be made expressly, explicitly, and in writing. A single waiver shall not constitute a continuing or general waiver of any subsequent breach or default.

32. Entire Agreement and Superseding Effect

These Terms, together with any related forms, consents, policies, and official communications issued by the organization, constitute the entire agreement between the participant and the organization with respect to the subject matter herein.

They supersede, replace, and override any prior discussions, representations, understandings, agreements, or communications, whether oral or written, relating to the Program.

The participant acknowledges that he or she has not relied on any statement, promise, or representation not expressly contained within these Terms.

33. Final Acknowledgment and Affirmation

By continuing participation, submission of data, or engagement with the Program, the participant affirms, declares, and acknowledges that:

* He or she has read, understood, and accepted these Terms in full;
* Participation is voluntary and may be withdrawn subject to the stated conditions;
* No guarantees of benefit, outcome, or compensation have been made beyond what is expressly stated;
* All information provided is given freely, knowingly, and without coercion;
* The participant accepts all risks, limitations, and conditions associated with participation.

Such acknowledgment shall be deemed valid and binding whether expressed through signature, digital confirmation, continued participation, or any other form of affirmative conduct.

34. Interpretative Construction and Linguistic Intent

These Terms shall be interpreted in a manner that gives full force, effect, breadth, and intentional meaning to each provision, clause, sentence, phrase, and expression contained herein. Words expressed in the singular shall, where the context so requires or permits, be deemed to include the plural, and vice versa; words importing one gender shall include all genders; and references to persons shall include individuals, entities, organizations, and associations, whether incorporated or unincorporated.

Headings, titles, captions, and sectional labels are inserted solely for convenience, reference, and navigational ease and shall not be used to limit, restrict, interpret, or otherwise affect the substantive meaning of any provision.

Any ambiguity, uncertainty, or interpretative doubt shall not be construed strictly against the drafter but shall instead be resolved in a manner that most faithfully reflects the purpose, structure, and intent of the Program as described herein.

35. Redundancy, Emphasis, and Reinforcement of Obligations

The participant acknowledges that certain provisions, statements, and obligations contained within these Terms may appear repetitive, reiterative, duplicative, or redundant in form, phrasing, or structure. Such repetition is intentional and deliberate, designed to emphasize, reinforce, and unequivocally communicate the importance, seriousness, and binding nature of the obligations undertaken.

Accordingly, no repetition shall be construed as superfluous, unnecessary, or lacking legal force; rather, each reiteration shall be interpreted as cumulative, supplementary, and confirmatory of the obligations described.

36. Good Faith, Fair Dealing, and Reasonableness

Both the participant and the organization agree, covenant, and undertake to act in good faith, with fairness, honesty, and reasonable conduct in the performance, execution, and observance of these Terms.

The participant shall not engage in conduct that is intentionally deceptive, manipulative, exploitative, or designed to undermine the Program, while the organization shall endeavor to administer the Program in a manner that is consistent, principled, and aligned with its stated objectives of privacy, integrity, and holistic analysis.

Notwithstanding the foregoing, the organization retains discretionary authority in matters of interpretation, implementation, and enforcement, provided such discretion is exercised in a manner that is not arbitrary, capricious, or manifestly unjust.

37. Electronic Consent and Digital Affirmation

The participant agrees that consent, acceptance, acknowledgment, and agreement to these Terms may be validly expressed through electronic means, including but not limited to digital signatures, checkbox confirmations, online submissions, email confirmations, or continued participation.

Such electronic acts shall carry the same legal weight, force, validity, and enforceability as a handwritten signature affixed to a physical document, and shall be deemed sufficient evidence of agreement in any administrative or legal context.

38. Survival of Provisions

Any provisions which, by their nature, purpose, or express wording, are intended to survive termination, withdrawal, expiration, or completion of participation shall remain in full force and effect notwithstanding such termination.

Without limitation, such surviving provisions shall include, but are not limited to, clauses relating to confidentiality, data use, intellectual property, limitation of liability, indemnification, dispute resolution, and interpretative construction.

39. Cumulative Rights and Remedies

All rights, powers, privileges, and remedies provided to the organization under these Terms are cumulative and not exclusive of any rights or remedies provided by law or otherwise available.

The exercise of any one right or remedy shall not preclude the simultaneous or subsequent exercise of any other right or remedy, whether similar or dissimilar in nature.

40. Program Suspension, Modification, or Termination

The organization reserves the absolute and unrestricted right to suspend, modify, restructure, reduce, expand, or terminate the Program, in whole or in part, at any time and for any reason deemed necessary, appropriate, or expedient.

Such action may arise from operational considerations, strategic changes, legal requirements, resource constraints, or other circumstances. In the event of termination, the organization may determine, at its discretion, whether certificates, incentives, or recognitions shall be issued in full, in part, or not at all, depending on the stage and condition of participation.

The participant agrees that no claim shall arise solely from such suspension, modification, or termination, provided that the organization has acted within the bounds of applicable law.

41. No Waiver of Fundamental Protections

Nothing in these Terms shall be construed as a waiver of any non-waivable rights afforded to participants under applicable law. If any provision is deemed to conflict with such rights, it shall be interpreted in a manner that preserves legal compliance while maintaining the closest possible alignment with the original intent.

42. Final Integration, Execution, and Binding Effect

These Terms shall become effective, binding, and enforceable upon the participant’s first act of submission, participation, or acknowledgment, and shall remain in effect for the duration of the participant’s involvement and thereafter as provided herein.

The participant affirms, declares, and reiterates—through act, conduct, and continued participation—that he or she has entered into these Terms freely, voluntarily, knowingly, and without undue influence, coercion, or misrepresentation.


FINAL DECLARATION

By participating in the Program, the participant:

* Confirms eligibility and truthfulness of provided information;
* Accepts the voluntary and non-prescriptive nature of the Program;
* Acknowledges the long-term observational structure (minimum one year, extendable);
* Understands privacy protections, blind-study handling, and internal data usage;
* Accepts that incentives, certificates, and recognition are conditional and discretionary;
* Agrees to all obligations, limitations, liabilities, and protections described herein.
